## The DMCA and Your Rights as a Creator

The [Digital Millennium Copyright Act](https://www.copyright.gov/legislation/dmca.pdf) (DMCA) was signed into law in the United States on 28 October 1998. Among other things, it created the notice-and-takedown process that creators use to ask websites, hosts and search engines to remove copies of their work.

In the United States, [copyright exists automatically](https://www.copyright.gov/what-is-copyright/) in an original work the moment it is fixed, for example when you record a video or take a photo. You do not need to register your work to send a takedown notice ([US Copyright Office](https://www.copyright.gov/512/)).

The DMCA gives you a notice-and-takedown route besides going to court. A host that wants the US "safe harbor" must designate an agent to receive notices and respond expeditiously to remove or disable access to the material after a valid notice ([17 U.S.C. 512](https://www.law.cornell.edu/uscode/text/17/512)). Search engines have their own safe harbor in the same section, for links to infringing material.

This guide explains the process step by step. Adult Model Protection is not a law firm and does not give legal advice.

## The Takedown Process Step by Step

1. **Find the copy and save the link.** Keep the exact URL of each copy, the page title and the date you found it. Do not download the copy or take screenshots of the page; the link is what the notice needs.
2. **Find where to send the notice.** Use the site's copyright form or the agent it lists. You can look up a host's agent in the Copyright Office's [DMCA Designated Agent Directory](https://www.copyright.gov/dmca-directory/).
3. **Send a complete notice.** The elements are listed below.
4. **Wait for the response.** The law says "expeditiously" and sets no fixed deadline.
5. **Check and follow up.** Note the date you sent each notice and follow up if nothing changes after a few days.

A host that follows the counter-notice rules of section 512(g) takes reasonable steps to tell the uploader that the material was removed, and the uploader can then file a counter-notice (see below).

## What a Valid DMCA Notice Contains

Under [17 U.S.C. 512(c)(3)(A)](https://www.law.cornell.edu/uscode/text/17/512), a notice to a host's designated agent includes:

- A physical or electronic signature of the copyright owner or a person authorized to act for them
- Identification of the copyrighted work, for example a link to the original post on your own page
- Identification of the infringing material and information reasonably sufficient to locate it: the exact URL of each copy, not just the site's home page
- Contact information that lets the host reach the sender; the law gives an address, a telephone number and, if available, an email address as examples
- A statement of good faith belief that the use is not authorized by the copyright owner, its agent or the law
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act for the owner

The statute's list does not mention a legal name; some sites still ask for one (see below). Each service that hosts a copy needs its own notice, so content on five sites means five notices. Our page on [DMCA takedowns for adult content](/services/dmca-takedowns-adult-content) explains each element in more detail.

![Six steps of a DMCA takedown: save the link, page title and date; find the site's copyright form or designated agent; send a notice with a signature, the work, each copy's URL, contact details and two statements; the host responds expeditiously, with no fixed deadline in the law; after a counter-notice the content may return after 10 to 14 business days unless a court action is filed; follow up and escalate to the host, registrar, ISP, Cloudflare or a payment processor.](/images/blog/blog-how-dmca-takedowns-work-a-creators-complete-guide.webp)

## Who Sees the Notice

Some platforms pass a notice on to the uploader, and some search engines and platforms send copies to the [Lumen database](https://lumendatabase.org/pages/about). Google, for example, [shares copies of notices with Lumen](https://support.google.com/legal/answer/12158374), including the sender's name, the rights holder's name and the reported URLs.

Adult Model Protection files notices under its own name as your authorized agent. The rights holder named on the notice is your model (stage) name, and the platform may show it to the uploader or Lumen may publish it. Your legal name is shared only with your consent, and only with a recipient that needs it and keeps it confidential; it is never shared with Google, Bing, X, Cloudflare or others that publish or forward notices.

## Working With Different Types of Platforms

**Search engines.** A search removal asks the search engine to drop a result; the page stays on its site until that site removes it. Google says the average processing time for Search removal requests sent through its web form is approximately 6 hours, and that many factors affect it ([Google Transparency Report help](https://support.google.com/transparencyreport/answer/7347743)). Bing takes notices through its [notice form](https://www.bing.com/webmaster/contentremovalform/showcontentremovalform) and publishes no processing time. Google also publishes copyright removal data in its Transparency Report. Our page on [search engine de-indexing](/services/search-engine-deindexing) explains this route.

**Social media.** Instagram, TikTok and X each have a copyright form, in the app or on the web; Instagram and TikTok ask for contact details and a signature. Our pages on [Instagram](/services/instagram-dmca), [TikTok](/services/tiktok-dmca) and [X](/services/twitter-x-dmca) explain each form.

**Adult sites.** Large adult sites publish their DMCA route: [Pornhub](https://help.pornhub.com/hc/en-us/articles/4419869469459-Filing-a-DMCA-Notice-of-Copyright-Infringement) has an online DMCA form, and [XVideos](https://info.xvideos.com/legal/tos) states in its terms that it will expeditiously remove infringing content in response to a valid takedown request. Some other sites ignore notices.

## When a Site Does Not Respond

A site is not legally required to remove content, but it loses the DMCA safe harbor protection if it does not act on a valid notice ([US Copyright Office](https://www.copyright.gov/512/)). Some sites ignore notices, and a US notice may carry little weight on a site outside the US. The next step is to contact the companies the site depends on: its hosting provider, domain registrar or internet provider, Cloudflare (which [forwards abuse reports](https://www.cloudflare.com/trust-hub/reporting-abuse/) to the host and site owner), or a payment processor.

A few sites ask for more than the law requires, such as identity documents. Share ID only with a recipient you trust and only if you decide to. Adult Model Protection does not submit ID documents for you.

## Counter-Notices

The uploader can file a counter-notice stating, under penalty of perjury, a good faith belief that the material was removed "as a result of mistake or misidentification" ([17 U.S.C. 512(g)(3)](https://www.law.cornell.edu/uscode/text/17/512)). A counter-notice includes the uploader's signature, identification of the removed material and where it was, that statement, and their name, address and telephone number with consent to the jurisdiction of a US federal district court.

After a valid counter-notice, the platform may restore the content after 10 to 14 business days unless it is told within that period that the copyright owner has filed a court action ([US Copyright Office](https://www.copyright.gov/512/)). For a US work, registration (or a refused application) is generally required before you can sue ([17 U.S.C. 411(a)](https://www.law.cornell.edu/uscode/text/17/411)), and registration takes time; ask a lawyer early if a counter-notice is likely.

When we file for you, our takedown team tells you when a counter-notice arrives and explains your options; the decision is yours, and we do not give legal advice.

## Your Responsibilities When Filing

Only file notices for content you own or are authorized to represent. The perjury statement in a notice is about your authority to act. Separately, anyone who knowingly and materially misrepresents that material is infringing can be liable for damages, including costs and attorney's fees ([17 U.S.C. 512(f)](https://www.law.cornell.edu/uscode/text/17/512)).

Keep a record of what you send: the URL, the site, the date of the notice, any reply and whether the copy is gone. The Adult Model Protection docs page on [effective takedowns](https://docs.adultmodelprotection.com/docs/best-practices/effective-takedowns) has more practical tips.

## Managing Many Takedowns

Filing many notices by hand takes a lot of time. One way to order the work:

1. Pages that rank for your name in Google and Bing, and the biggest sites
2. New copies, before they are copied further
3. Your most exclusive content

Group similar sites together, keep a template for each type of site, and track each notice in a spreadsheet with the URL, site, date sent, reply and status.

Copies often come back under a new URL after a removal, so check again later. Google Alerts for your stage name can tell you when it appears on a new page, and our guide on [detecting content leaks](/blog/how-to-detect-content-leaks-before-they-go-viral) covers other free checks. To see how a takedown service compares with filing yourself, read [our comparison](/blog/takedowns-ai-vs-manual-dmca-which-better).

## Prevention

Some creators add a visible watermark with their stage name or page address, use recognisable backgrounds or settings, or post free previews in lower resolution. These are choices you can make; none of them stops copying, but a watermark makes copies easier to find with a text search and links them to you. AMP's own watermarking is in development and not yet available.

## Filing Yourself or With AMP

You can file every route in this guide yourself, for free. What Adult Model Protection adds: regular scans by our team on paid plans of search engines and more than 500 known leak and piracy sites, a notice for each copy within your plan (Essentials: up to 100 platform notices a month; Luxe and higher: unlimited) filed under our name as your authorized agent, a person who checks every notice before it is sent, removal checks after each notice, escalation when a site ignores us, and new notices for copies found again in later scans. Takedowns start on the Essentials plan, social media removals are on the Luxe and higher plans, and the Free plan includes a quarterly web scan, so you can see where copies of your content appear.
